These Terms of Use ("Terms") govern your access to and use of the Employee Cost Calc website and the Employee Cost Calculator (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

The Service is a free, browser-based estimating tool that helps users approximate the fully-loaded cost of an employee. All calculations run in your browser using editable default rates that you can change.

2. Not professional advice; estimates only

The Service is provided for general informational and planning purposes only. It is not tax, legal, accounting, financial, payroll, insurance, or other professional advice, and no professional or advisory relationship is created by your use of it. All outputs are rough estimates, not guarantees or quotes. Built-in default rates — including federal payroll taxes, state unemployment (SUTA), workers' compensation, benefits, retirement, and overhead — are approximations that change over time and vary by employer, state, industry, insurance carrier, wages, and individual circumstances.

3. Your responsibilities

You are solely responsible for independently verifying all figures with the IRS, your state agencies, your insurance carrier, and a qualified accountant, attorney, or payroll professional before making any hiring, business, financial, or tax decision. You agree to use the Service only for lawful purposes.

4. No warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF ACCURACY, COMPLETENESS, CURRENCY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that any result is accurate or applicable to your situation.

5. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EMPLOYEE COST CALC AND ITS OWNER, OPERATORS, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, OR ANY OTHER LOSS, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, OR RELIANCE ON, THE SERVICE OR ITS RESULTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6. Indemnification

You agree to indemnify and hold harmless Employee Cost Calc and its owner and operators from any claims, damages, liabilities, and expenses arising out of your use of the Service or your violation of these Terms.

7. Intellectual property

The Service, including its design, text, and code, is owned by Employee Cost Calc or its licensors and is protected by applicable laws. You may use the Service for its intended purpose but may not copy, resell, or redistribute it without permission.

8. Advertising and third-party links

The Service may display third-party advertising (including Google AdSense) and may link to third-party sites. We are not responsible for third-party content, products, or practices. See our Privacy Policy for details on advertising cookies.

9. Changes

We may modify the Service or these Terms at any time. Changes to these Terms are effective when posted with an updated "Last updated" date. Your continued use after changes constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there.
